REAL ESTATE AUCTION TERMS AND CONDITIONS

* All properties sell to the HIGHEST BIDDER, at all auction sales, whether an Absolute Auction (regardless of price) or  Reserve Auction Sale (reserved price with min. upset).
* All properties are sold “AS IS” with no warranties announced or otherwise implied.
* 5% to 10% buyer’s premium charged on each property, depending on the specific sale and property.  Each individual sale advertisement will specifically announce the buyer's premium.
* Broker participation welcomed.  Broker's will be paid a commission rate of 2% of the selling price,  unless otherwise indicated by each individual sale, ie:  ___% Broker Participation.
* $10,000. to $100,000., as per each individual sale, cash or cashier’s check made payable to CASALE & CO., Auctioneers must be displayed to bid and obtain auction paddle. 
* 10% deposit by check (which will include $10,000.00 bank check, and appropriate balance) will be collected day of auction, balance due at closing of title within 30 days of auction date.
* Buyer obtains possession with deed at closing.
* Current year real estate taxes to be paid by buyer. 
* Any mortgages, leins or encumbrances (except current year real estate taxes and water & sewer) will be satisfied by the seller at closing of title.
* Any outstanding water & sewer assessments will be pro-rated per diem.
* All closing costs are the expense of the buyer, including but not limited to title search, title insurance, transfer taxes, mortgage taxes, attorney fees, surveyor fees and the like.
* Bidder's are requested to register prior to the sale, but can do so one hour before the auction sale at the location of the sale.
* Property inspections will be held as advertised and one week prior to the sale at an "Open House" and the day of the sale or by appointment to pre-registered bidders with a bank pre-qualification, call the auctioneers office to arrange same.
* All properties to be auctioned at the date and time posted, no property may be purchased prior to the auction sale.  All sales are final.  Winning bidder's failure to complete transaction within 30 days will forfeit 10% down payment at auction sale contract signing. 
* Any and all announcements made at the auction by the Licensed  Auctioneer supercede any written terms.
